About GST Registration

Concept

The Goods and Services Tax (GST) is a unified indirect tax system that combines various taxes such as VAT, CST, Service Tax, Central Excise duty, Entertainment Tax, among others. It became effective nationwide from July 1, 2017.

 When to register for GST 

Registration under the Goods and Services Tax (GST) becomes compulsory if either the annual turnover surpasses INR 40/20 lakh or goods and services are supplied across state borders or via E-commerce platforms.

What are the GST tax rates

Tax rates can range between 0% and 28%, contingent upon the specific categories of goods and the characteristics of services being offered. The variation in rates is determined by the nature and type of products or services being sold.

Input Tax Credit Availment

Only those business units that are registered under GST are eligible to claim a credit for the taxes paid during purchases when they file their GST returns. This credit allows businesses to offset the taxes they've paid on inputs against their GST liability, thereby promoting compliance and facilitating smoother financial operations.

Return Filing & Payment

Every GST-registered entity must submit monthly or quarterly returns and one annual return. 

 Composition Scheme  

Business units with an annual turnover below INR 1.5 crore have the option to participate in the scheme. They are required to pay a reduced tax rate ranging from 1% to 5% and must file quarterly tax returns.

What is GSTIN?

GSTIN stands for Goods and Services Tax Identification Number. It is a unique 15-digit alphanumeric code assigned to every business registered under the Goods and Services Tax (GST) regime in India. GSTIN is issued by the Goods and Services Tax Network (GSTN), which is a government entity responsible for administering the GST system in the country. The GSTIN is used for identification and verification of a registered taxpayer for all GST-related transactions. Each state in India has a specific code within the GSTIN, making it possible to identify the state of registration of the taxpayer.

4. Inter-state Trade: GST registration allows businesses to sell goods/services across India without any restrictions. Without GSTIN, inter-state trade is not permissible.

5. Government Tenders: Many government tenders require GSTIN for participation. Lack of GST registration could result in missing out on lucrative business opportunities.

6. Bank Account Opening: Sole proprietorships often face hurdles in opening business accounts without government-issued business proofs. A GST registration certificate serves as a valid document to open a current bank account.

7. Dealing with MNCs: Multinational corporations typically prefer to engage with businesses that possess valid tax registration, ensuring compliance and credibility in transactions.

Different criteria for GST registration

In India, businesses need to register for GST (Goods and Services Tax) under specific criteria outlined by the GST law. Here are the different criteria for GST registration:

1. Mandatory Registration:
   - Turnover Threshold: Businesses whose aggregate turnover (aggregate turnover includes taxable, exempt, and export turnover) exceeds the prescribed threshold limit. The threshold limits are:
     - Regular States: Rs. 40 lakhs (Rs. 20 lakhs for special category states).
     - Service Providers: Rs. 20 lakhs.
   - Inter-State Supply: Businesses making inter-state taxable supply of goods/services, irrespective of turnover.
   - Casual Taxable Persons: Persons who occasionally undertake transactions involving supply of goods/services in a taxable territory where they have no fixed place of business.
   - Non-Resident Taxable Persons: Non-resident persons making taxable supply of goods/services in India.
   - E-commerce Operators: Persons who are required to collect tax at source under GST.
   - Input Service Distributors: Persons who distribute input tax credit by way of issuing invoices to claim credit of tax paid on inputs.

2. Voluntary Registration:
   - Any person, irrespective of turnover, can opt for voluntary GST registration to avail the benefits of GST registration.

3. Compulsory Registration:
   - Certain categories of persons are required to register under GST, even if their turnover is below the threshold. These include:
     - Persons Supplying Goods/Services through E-commerce: E-commerce operators and persons supplying goods/services through e-commerce platforms.
     - Casual Taxable Persons: Persons who occasionally undertake transactions involving supply of goods/services.
     - Non-Resident Taxable Persons: Non-resident persons making taxable supply of goods/services in India.

Businesses meeting any of these criteria must register for GST and obtain a GSTIN (Goods and Services Tax Identification Number) before commencing operations. This registration helps businesses comply with GST regulations and enables them to avail input tax credit on purchases, collect tax from customers, and file GST returns.

Documents Required for GST Registration

1. PAN Card of the Business or Applicant:- GSTIN is linked to the PAN of the business. Hence, PAN is required to obtain GST certificate.

2. Identity and Address Proof of Promoters:- documents like PAN, passport, driving license, aadhaar card or voters identity card must be submitted for all the promoters.

3. Address Proof for Place of Business:- Documents like rental agreement or sale deed along with copies of electricity bill or latest property tax receipt or municipal khata copy must be submitted for the address mentioned in the GST application.

4. Bank Account Proof:- Scanned copy of the first page of bank passbook showing a few transaction and address of the business must be submitted for the bank account mentioned in the registration application.
